Terms of Use

The rules for using the Atlanta Church Creatives platform.

These terms apply when you create an account, publish a profile, post or apply for an opportunity, request availability, upload content, or buy access through the Job Board.

1. Agreement and operator

These Terms of Use form an agreement between you and Atlanta Church Creatives, LLC, a Georgia limited liability company and the operator of the Atlanta Church Creatives jobs and talent platform. By using the platform or selecting an agreement checkbox, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the platform.

2. Age and authority

You must be at least 18 years old to create an account, publish a creative profile, post an opportunity, apply through the Job Board, or purchase platform access. If you use Atlanta Church Creatives for a church, organization, company, or other entity, you represent that you are authorized to act for that entity and bind it to these Terms.

3. Atlanta Church Creatives is a platform, not the employer

Atlanta Church Creatives provides a platform where organizations and creatives can discover one another and exchange opportunity information. Unless Atlanta Church Creatives expressly identifies itself as the hiring party in a separate written agreement, Atlanta Church Creatives is not the employer, staffing agency, recruiter, agent, contractor, or hiring party for third-party listings. The organization and creative are solely responsible for deciding whether to communicate, interview, hire, contract, volunteer, pay, or work together.

Atlanta Church Creatives does not guarantee the existence, accuracy, legality, safety, quality, or completeness of any listing, profile, portfolio, organization, user, application, compensation statement, or opportunity. Atlanta Church Creatives does not guarantee applicants, responses, interviews, employment, engagements, hires, payment, compensation, results, or the conduct or performance of any user.

4. No vetting or background checks

Atlanta Church Creatives may use automated or manual publishing checks to support platform quality, but those checks are not an endorsement, credential verification, background check, reference check, safeguarding review, or guarantee of legitimacy or character. Atlanta Church Creatives does not independently verify every user's identity, credentials, licenses, insurance, portfolio ownership, criminal history, employment history, or authority to hire.

Users engage with one another at their own risk. Hiring organizations are responsible for all legally and operationally appropriate screening, reference checks, background checks, safeguarding procedures, supervision, and policies, especially for roles that may involve minors, vulnerable people, finances, confidential information, facilities, or equipment.

5. Accounts and accurate information

You must provide accurate, current, and complete information, protect your sign-in credentials, and promptly update information that changes. You are responsible for activity under your account. Atlanta Church Creatives may request clarification, restrict access, or take action when information appears false, misleading, unsafe, unauthorized, or inconsistent with the platform's purpose.

6. Profiles, content, and portfolio media

You retain ownership of content you submit. Atlanta Church Creatives does not take ownership of your photography, video, graphics, audio, documents, or other uploaded work. You represent that you own the content or have all permissions needed to upload and display it.

You grant Atlanta Church Creatives a non-exclusive, worldwide, royalty-free license to host, copy, format, resize, transcode, review, moderate, display, and showcase the content as needed to operate, secure, and improve your creative profile and the Atlanta Church Creatives platform. This license also permits Atlanta Church Creatives to showcase the content through the Atlanta Church Creatives Job Board and related community channels when the purpose is helping promote you, your creative profile, or the Job Board. Any materially different use requires separate permission. This license ends when the content is deleted from active Atlanta Church Creatives systems, except for reasonable backup, legal, and audit retention.

You may not upload content that infringes copyright, trademark, privacy, publicity, confidentiality, or other rights.

6a. Copyright complaints (DMCA)

If you believe content on the platform infringes your copyright, send a notice to Atlanta Church Creatives' designated agent: Copyright Agent, Atlanta Church Creatives, LLC, [STREET-FORMAT MAILING ADDRESS], legal@atlchurchcreatives.com.

Your notice must include: (1) identification of the copyrighted work claimed to be infringed; (2) identification of the material claimed to be infringing and information reasonably sufficient for Atlanta Church Creatives to locate it; (3) your name, address, telephone number, and email address; (4) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; (5) a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf; and (6) your physical or electronic signature.

Atlanta Church Creatives may remove or disable access to the identified material while a claim is reviewed and will take reasonable steps to notify the user who posted it. That user may submit a counter-notice to the designated agent containing the elements described in 17 U.S.C. § 512(g)(3), including identification of the removed material and its prior location, a statement under penalty of perjury of a good-faith belief that the material was removed by mistake or misidentification, consent to the jurisdiction of the federal district court for the user's address (or, if outside the United States, any judicial district in which Atlanta Church Creatives may be found), consent to accept service of process from the person who filed the original notice, and the user's physical or electronic signature. If Atlanta Church Creatives receives a compliant counter-notice, it may restore the material in accordance with the DMCA unless the original claimant notifies Atlanta Church Creatives that it has filed a court action seeking to restrain the alleged infringement.

Atlanta Church Creatives will terminate, in appropriate circumstances, the accounts of users who are repeat infringers.

7. Job posts, applications, and classifications

Posters must follow the Atlanta Church Creatives Job Posting Policy and are responsible for accurate duties, location, schedule, compensation, application routing, and authorization. Applicants are responsible for accurate experience, availability, work samples, and other application details.

Posters, creatives, and their advisers are responsible for determining whether a relationship is properly classified as employment, independent contracting, internship, temporary work, or volunteering. A label selected on Atlanta Church Creatives does not determine legal classification, tax treatment, wage obligations, benefits, or worker rights.

8. Faith-based hiring and employment laws

Some religious organizations may lawfully consider faith, denomination, doctrine, or ministerial function for certain roles. The scope of any religious exemption or ministerial exception depends on the organization, role, facts, and applicable law. Atlanta Church Creatives does not decide whether a criterion is lawful. Posters are responsible for obtaining legal advice and complying with all applicable employment, civil-rights, wage, classification, accessibility, and advertising laws.

9. Applications, availability, and direct contact

Atlanta Church Creatives may route applications, profile proof, contact information, availability requests, budgets, dates, and role context between users. A response, introduction, or contact reveal does not create an employment, agency, partnership, contractor, fiduciary, or other relationship with Atlanta Church Creatives. Users are responsible for final contracts, payment terms, taxes, insurance, intellectual-property terms, releases, safety, and workplace expectations.

10. Payments and refunds

Square or another disclosed third-party processor handles card payments. Atlanta Church Creatives does not store full payment-card numbers. Your use of payment services may also be subject to the processor's terms and privacy practices. Pricing, renewals, cancellations, credits, and refunds are governed by the checkout description and the Refund and Cancellation Policy.

11. Prohibited conduct

You may not post fake or unlawful opportunities; request payment from applicants; use Atlanta Church Creatives for scams, harassment, scraping, spam, malware, unauthorized recruiting schemes, or discrimination prohibited by applicable law; bypass protected contact controls; interfere with platform security; impersonate another person or organization; misuse payments; or access records or accounts you do not own.

12. Moderation, suspension, and termination

Atlanta Church Creatives may review, edit for clarity, restrict, reject, pause, hide, remove, preserve, or report content, listings, profiles, applications, or accounts when Atlanta Church Creatives reasonably believes action is needed to enforce these Terms, protect users, follow law, respond to a report, prevent harm, or maintain platform quality. Atlanta Church Creatives may suspend or terminate access for violations or risk. Where practical, Atlanta Church Creatives may explain the action and offer a way to correct an issue, but immediate action may be necessary.

13. Disclaimers

The platform is provided on an "as is" and "as available" basis to the fullest extent permitted by law. Atlanta Church Creatives disclaims warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and results. Atlanta Church Creatives does not promise that the platform will be uninterrupted or error-free.

14. Limitation of liability

To the fullest extent permitted by law, Atlanta Church Creatives and its owners, officers, workers, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, data, opportunities, goodwill, or business; user conduct; hiring or classification decisions; workplace events; or disputes between users. To the fullest extent permitted by law, Atlanta Church Creatives' total liability arising from the platform will not exceed the greater of $100 or the amount you paid Atlanta Church Creatives for the specific service giving rise to the claim during the six months before the event.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of certain damages. If these laws apply to you, some or all of the disclaimers, exclusions, or limitations in Sections 13 and 14 may not apply, and you may have additional rights. In that case, Atlanta Church Creatives' liability is limited to the greatest extent permitted by applicable law.

15. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Atlanta Church Creatives and its owners, officers, workers, contractors, and service providers from third-party claims, losses, liabilities, costs, and reasonable legal fees arising from your content, listing, hiring or work relationship, classification decision, payment obligation, violation of law, infringement of rights, or breach of these Terms.

16. Governing law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules. Any court proceeding arising out of or relating to these Terms or the platform must be brought exclusively in the state or federal courts located in [COUNTY] County, Georgia, unless applicable law gives you the right to bring the proceeding elsewhere. You and Atlanta Church Creatives consent to the personal jurisdiction and venue of those courts.

17. Changes and general terms

Atlanta Church Creatives may update these Terms as the platform changes. The effective date above identifies the current version. Material changes may be presented through the site, email, or a new acceptance step. If one provision is unenforceable, the remaining provisions continue. Atlanta Church Creatives' failure to enforce a provision is not a waiver. You may not transfer your agreement without Atlanta Church Creatives' permission.
